1. Description of Services

My Thai Buddy provides virtual personal assistant services and will, in the future, offer in-person personal assistant services to Western tourists and expatriates in Thailand. Services include, but are not limited to, pre-arrival planning, research, booking assistance, local navigation help (for in-person services), errand running (for in-person services), and general lifestyle support as detailed on our Site and in specific service package descriptions.

To access certain features of the Service, you may be required to create an account. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

By using our Services, you agree to:

• Provide accurate, current, and complete information as requested.
• Use the Services in a lawful manner and for lawful purposes only.
• Not use the Services to harass, abuse, or harm another person.
• Be responsible for your own conduct and any content you provide.

5. Bookings, Payments, and Fees

• Service Fees: Fees for our Services are as described on our Pricing page or as quoted for custom services. Prices are subject to change.
• Payment: We accept payments through Stripe and other methods as indicated on our Site. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.
• Additional Costs: You are responsible for any additional costs incurred on your behalf during the provision of services (e.g., cost of goods purchased, tickets, entrance fees, PA's transportation for client-specific tasks), which will be communicated and agreed upon beforehand.
• Surcharges: Services requested outside of standard business hours or on weekends/public holidays may be subject to a surcharge as indicated on our Pricing page.

6. Cancellation and Refund Policy

• Satisfaction Guarantee: We strive to provide excellent service. As stated on our Pricing page, we offer a satisfaction guarantee on all packages.
• Refunds: If our service standards are not met, you may be eligible for a full or partial refund, subject to our review of the circumstances. Please contact us to discuss any issues.
• Cancellation by You: Please refer to the specific cancellation terms provided at the time of booking for any package or hourly service.
• Cancellation by Us: We reserve the right to cancel or refuse service at our discretion, for reasons including but not limited to non-payment, violation of these Terms, or requests for services outside our defined scope.

7. Intellectual Property

The Site and its original content, features, and functionality are and will remain the exclusive property of My Thai Buddy and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of My Thai Buddy.

8. Third-Party Links

Our Site may contain links to third-party web sites or services that are not owned or controlled by My Thai Buddy. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

In no event shall My Thai Buddy, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

You agree to defend, indemnify and hold harmless My Thai Buddy and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall first be attempted to be resolved through amicable negotiations. If a resolution cannot be reached, disputes shall be submitted to the competent courts of Thailand.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
